Dies wird in der technischen Kommunikation durch Standardisierung erreicht. Standards, wie etwa die Mobilfunk-Standards LTE oder 5G, verbreiten die Nutzung der Kommunikationstechnologie, da Produkte auch unterschiedlicher Hersteller miteinander kommunizieren k\u00f6nnen. Im Grunde bilden Standards den Gegenpol zu Monopolrechten, die einen einzigen Marktteilnehmer beg\u00fcnstigen.<\/p>\n\n\n\n<p>Doch was, wenn ein Unternehmen ein Patent auf die im Standard verwendete Technologie h\u00e4lt? Kann der Patentinhaber den Standard torpedieren und sein Patent gegen die Nutzer des Standards durchsetzen, d.h. diese von der Nutzung des Standards ausschliessen? Mittlerweile gibt es in Europa gesicherte Rechtsprechung, die diese Fragen beantwortet: Nach Huawei vs. ZTE ist etwa der Inhaber eines standardessentiellen Patents dazu verpflichtet, ernsthafte Verhandlungen \u00fcber die Lizenzierung des Patents aufzunehmen unter sogenannten FRAND-Bedingungen (Fair, Reasonable, and Non-Discriminatory).
